1. Agreement to Terms

By accessing our website or using the services of Krause Tree & Excavation LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use our services.

2. Services Provided

Krause Tree & Excavation LLC provides professional tree removal, tree trimming, stump grinding, excavation, and land clearing services in Clearfield County, Pennsylvania and surrounding areas. All services are subject to:

Site evaluation and safety assessment
Weather conditions and seasonal limitations
Equipment availability
Local permits and regulations

3. Estimates and Pricing

3.1 Free Estimates

We provide free, no-obligation estimates for all services. Estimates are valid for 30 days from the date provided.

3.2 Final Pricing

Final pricing may vary from estimates if:

Hidden conditions are discovered during work
Scope of work changes at customer request
Additional safety measures are required
Unforeseen complications arise

We will notify you of any price changes before proceeding with additional work.

4. Payment Terms

Payment is due upon completion of work unless other arrangements are made in writing
We accept cash, check, and major credit cards
Returned checks will incur a $35 processing fee
Accounts past due 30 days may be subject to late fees and/or collection proceedings

5. Customer Responsibilities

Customers must:

Provide accurate information about property lines and underground utilities
Ensure clear access to work areas
Remove or secure pets during service
Obtain necessary permits when required (we can assist with this process)
Mark any sprinkler systems, septic lines, or other underground hazards

6. Safety and Liability

6.1 Insurance

Krause Tree & Excavation LLC maintains comprehensive general liability insurance and workers' compensation coverage. Proof of insurance is available upon request.

6.2 Property Damage

While we take every precaution to protect your property, tree work and excavation involve inherent risks. We are not liable for:

Damage to unmarked underground utilities or structures
Pre-existing damage or decay not visible during inspection
Damage resulting from customer's failure to disclose hazards
Acts of God or severe weather events

7. Work Guarantee

We stand behind our work with the following guarantees:

Workmanship warranty for 30 days from completion
Stump grinding to specified depth
Complete cleanup of work areas
Professional and safe work practices

8. Emergency Services

Emergency services are available 24/7. Emergency rates may apply for:

After-hours service (evenings, weekends, holidays)
Immediate response requirements
Hazardous conditions requiring special equipment or expertise

9. Cancellation Policy

Non-emergency services may be cancelled without penalty with 24 hours notice
Cancellations with less than 24 hours notice may incur a service fee
We reserve the right to reschedule due to weather or safety conditions

10. Wood and Debris Disposal

Unless otherwise agreed:

All wood and debris will be removed from the property
Customers may request to keep wood for personal use
Wood chips from grinding may be left for mulch upon request

11. Limitation of Liability

To the maximum extent permitted by law, Krause Tree & Excavation LLC's total liability for any claim arising from our services shall not exceed the amount paid for those specific services.

12. Indemnification

Customer agrees to indemnify and hold harmless Krause Tree & Excavation LLC from any claims arising from customer's failure to disclose known hazards or obtain necessary permits.

13. Governing Law

These terms shall be governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved in the courts of Clearfield County, Pennsylvania.

14. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website and will apply to services contracted after the posting date.
